Quotations

Validity

All quotations are valid for 30 days from the date of the quotation and are subject to change thereafter.

Acceptance of quotation

A contract is formed when the client accepts a quotation by signing it, approving it by email, issuing a purchase order, paying a requested deposit or instructing Evacu8 Solutions to commence the work.

Acceptance of the quotation also constitutes acceptance of these Terms and Conditions.

Quality and options

Evacu8 Solutions will provide a quotation based on the specified materials, artwork and production requirements. Alternative options may be quoted at the client’s request where available.

Quotations and variations

Quotations are prepared in good faith from the information available when the quotation is issued.

If project information is incomplete, inaccurate or subsequently changed, or if the client requests a change to the agreed quantities, specifications, artwork, materials, services or delivery requirements, Evacu8 Solutions may issue a revised quotation or written variation.

Additional work will not proceed until the client has accepted the additional scope and applicable charges in writing.

Additional extras

Extras, such as protective coatings, are not automatically included in quotations. When included, they will be identified in the quotation.

Project information and limited site attendance

Client-supplied and confirmed information

Quotations and artwork are prepared from the plans, measurements, mark-ups, photographs, schedules, site information and other project information supplied or confirmed by the client, fire contractor or nominated project contact.

The client is responsible for ensuring that the supplied or confirmed information is current, complete and accurate and for nominating an authorised person to review and approve the artwork.

Additional drafting, artwork changes, reprinting, production, delivery, site attendance or other additional project services required because information was incomplete, inaccurate or subsequently changed will be subject to a separate quotation or written variation.

Limited site attendance

Where expressly included in an accepted written quotation, Evacu8 Solutions may attend the site to:

  • visually observe accessible areas
  • compare supplied plans with visible conditions
  • photograph or mark apparent equipment and proposed sign locations
  • identify proposed viewing orientations
  • take measurements relevant to sign production or mounting
  • discuss preliminary sign or assembly-area options for consideration by the project team

Site attendance does not constitute:

  • a building survey
  • a fire safety inspection
  • a compliance audit
  • an investigation of concealed conditions
  • fire-system testing
  • fire-system commissioning
  • fire-system design
  • building certification
  • certification of evacuation arrangements

Any evacuation routes, assembly information, emergency procedures, equipment information, sign locations and other safety-critical details must be reviewed and confirmed by the client or its nominated competent project representative before final artwork approval.

Artwork

Print readiness

No artwork-preparation charges are incurred where files are supplied in an acceptable print-ready format. Files that require correction, rebuilding or preparation may incur additional charges identified in the quotation or a written variation.

Licensing

It is the client’s responsibility to obtain all rights and licences required to reproduce logos, photographs, plans or artwork not created by Evacu8 Solutions.

Original files

Artwork provided to Evacu8 Solutions should be a copy of the client’s original. Evacu8 Solutions accepts no responsibility for the loss of the client’s only original artwork file.

Artwork and drafting charges

Artwork setup, drafting, design and revisions may be charged at a fixed or hourly rate depending on the project. The applicable basis will be specified in the quotation.

Proofing and colour

Colours viewed on screen are not a guaranteed representation of the final printed product. Printed proofs or specific colour-matching requirements can be quoted where requested. Colour may vary between materials and production methods.

Responsibility for artwork information

Evacu8 Solutions prepares artwork from information supplied or confirmed by the client, fire contractor or nominated project contact.

The client or nominated project contact must review the final artwork and confirm that the depicted locations, routes, equipment, assembly information, emergency wording, orientation, quantities, branding and other project-specific information are correct.

Evacu8 Solutions is entitled to rely on information and approval provided by the contact nominated by the client.

Written approval does not relieve Evacu8 Solutions of responsibility for a production error or for completed goods that materially differ from the approved artwork.

Written artwork approval

Printing and production will not begin until the final artwork has been approved in writing by the client or nominated project contact.

Written approval may be provided by email, signed proof, electronic approval system or another written method accepted by Evacu8 Solutions.

Changes requested after written approval, including changes arising from incomplete, inaccurate or subsequently changed project information, will be subject to additional drafting, reprinting and production charges.

Artwork specifications

Preferred finished artwork is supplied as a print-ready EPS, AI or PDF file with fonts converted to outlines. Artwork supplied in other formats may require additional preparation and charges.

Artwork ownership

Artwork provided to a client remains the property of Evacu8 Solutions until payment in full has been received. Digital or physical reproduction of that artwork without written permission, other than for proofing, is not permitted.

Services not included

Unless expressly included in a separate written quotation, Evacu8 Solutions does not provide:

  • fire engineering
  • fire-system design
  • fire-system inspection, testing or commissioning
  • compliance auditing or certification
  • building-classification advice
  • Fire Safety Adviser services
  • emergency planning committee services
  • emergency procedures manuals
  • evacuation exercises
  • emergency training
  • certification that project information, evacuation arrangements or a completed building comply with applicable legislation, standards, approvals or certification requirements

The preparation of artwork from supplied or confirmed information does not constitute independent design or certification of the underlying fire safety or evacuation arrangements.

Materials and mounting preparation

Materials and mounting preparation

The quotation will identify the agreed panel material, finish and any mounting preparation included in Evacu8 Solutions’ production scope, such as specified holes, backing or double-sided mounting tape.

Installation requirements and any additional project services will be confirmed in the accepted quotation. The responsible party, scope, access requirements and mounting method must be recorded in writing where applicable.

The client or installer is responsible for assessing the mounting surface, site conditions, required fixing method, suitability of any adhesive or mechanical fixing and any approvals required for the mounting location.

The provision of holes, tape, backing or other mounting preparation does not constitute installation or confirmation that the fixing method is suitable for every substrate or site condition.

Timeframes

Evacu8 Solutions will provide project-specific drafting, production, dispatch or delivery timeframes based on the information supplied, the condition of existing artwork, the number and complexity of unique signs, quantities, materials and finishing requirements, requested revisions and the required completion date.

Drafting schedules begin once the information required for the agreed scope has been received. Printing and production will not begin until the final artwork has been approved in writing.

Unless expressly identified in the quotation as guaranteed, stated drafting, production, dispatch and delivery dates are estimates.

Timeframes may be affected by incomplete or changed project information, client-requested revisions, delayed artwork approval, accepted variations, material availability, equipment failure, supplier or freight delays, site access restrictions or circumstances outside Evacu8 Solutions’ reasonable control.

A production-completion or dispatch date is not a guarantee of the date on which a freight carrier will deliver the goods.

Payment terms

Evacu8 Solutions requests payment by COD for first-time customers. Clients may apply for account terms by completing an Account Application form. Account terms only apply after approval.

Invoices will be emailed unless otherwise requested. Payment is due on or before the due date stated on the invoice.

Available payment methods include direct deposit using the bank details provided on the invoice and cash on delivery where agreed.

Overdue accounts

If an invoice is overdue, Evacu8 Solutions may suspend current work, delay dispatch or release of uncollected goods, withdraw account facilities, place the client on COD terms or require payment before commencing or continuing further work.

The client is responsible for reasonable external debt-recovery and legal costs actually incurred by Evacu8 Solutions in recovering an overdue amount, to the extent permitted by law.

Ownership of goods

All goods will remain the property of Evacu8 Solutions until all associated costs are paid in full.

Defects, damage and Australian Consumer Law

The client should inspect completed goods promptly after delivery or collection and notify Evacu8 Solutions as soon as reasonably possible of any visible freight damage, shortage, production error, material difference from the approved artwork or apparent manufacturing defect.

Notification within seven days assists Evacu8 Solutions in investigating freight and production issues but does not exclude or limit any right or remedy that cannot lawfully be excluded or limited.

Where a claim is accepted, Evacu8 Solutions may inspect the goods and determine an appropriate remedy having regard to the nature of the issue and any applicable legal requirements.

Nothing in these Terms and Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or other applicable law.

Client-supplied information and third-party rights

The client indemnifies Evacu8 Solutions against third-party claims, losses and reasonable costs arising directly from:

  • inaccurate, incomplete or unauthorised information supplied or approved by the client
  • client-supplied logos, photographs, plans, artwork or other material that infringes another person’s intellectual-property rights
  • changes directed or approved by the client
  • installation, alteration or use of completed goods by the client or another party contrary to the approved specification or supplied instructions

This indemnity does not apply to the extent that the claim, loss or cost was caused or contributed to by Evacu8 Solutions’ negligence, breach of contract, a production error or completed goods materially differing from the approved artwork.

Responsibility for project information and compliance

Evacu8 Solutions prepares evacuation diagrams in accordance with the agreed scope, nominated requirements and information supplied by the client.

Evacu8 Solutions does not independently certify the building, fire systems, emergency procedures, evacuation routes, assembly arrangements or the accuracy or regulatory compliance of information that has not been independently designed, inspected or certified by Evacu8 Solutions under a separate written professional-services scope.

The client remains responsible for obtaining any advice, inspection, approval or certification required from a suitably qualified person or authority.

Evacu8 Solutions remains responsible for exercising reasonable care and skill in performing the services expressly included in the accepted quotation and for supplying completed goods that materially match the approved artwork.
